[I’m kicking this back up to the top. At the time I wrote this, I thought it might be enough to make the jackasses at ePerks.com come to their senses. Apparently not. If you are a real estate weblogger, and if you don’t want some sleazoid attorney pulling these stunts on you, you need to set your shoulder beside Vlad Zablotskyy’s and fight for your right to free speech. Let the world know that this kind of behavior is unacceptable. –GSS]
Sleazeball lead vendor ePerks.com (corporate motto: “We don’t totally suck because we can’t get anything right!”) has found a great new way to respond to criticism: Censorship.
Real estate weblogger Vlad Zablotskyy exposed ePerks to what by BloodhoundBlog standards amounts to very mild scrutiny. His posts elicited a number of horror stories from Realtors who had been misused in their dealings with ePerks.
So far nothing surprising. Lead vendors suck. They persist by virtue of creating an artificial marketing chokepoint, interposing themselves between consumers and the vendors who can satisfy their needs:
In the Web 1.0 world, lead vendors snapped up domains and fought hard for dominance on organic and pay-per-click keywords relating to real estate sales, mortgage origination and refinancing. By these means, they harvested contact information from interested parties, which they were then able to sell to Realtors and lenders, often for enormous fees. The lead vendors created an artificial chokepoint by marketing, then charged practitioners a premium to gain access to the consumers trapped at that chokepoint.
It is hardly shocking that most of the victims of lead vendors come to hate the scum who run these scams.
In the long run none of this matters. The Web 2.0 world disintermediates all man-made chokepoints. ePerks.com is one with the dinosaurs — and sic semper tyrannosauris!
But wait. There’s more. Instead of ignoring criticism on what is (sorry, Vlad) a low-traffic weblog, instead of asking itself “What would David Gibbons do?”, instead of engaging the enraged while retooling the chokepoint like Homegain.com’s Louis Cammarosano, ePerks.com chose to do the stupidest thing any corporation or government can do in the Web 2.0 world: It sent a threatening letter to a weblogger.
Witness: One Ronald J. Cook, an attorney for Willoughby, Stuart & Bening in San Jose, penned this deathless prose:
You are hereby instructed to terminate your ongoing efforts to unfairly disparage and slander ePERKS.com through the dissemination of false and/or manufactured information. Any resistence to our demands will be met with swift and decisive action.
Doesn’t that sound like the leader of the alien invasion in a bad sci-fi movie? “Attention, Earthlings! Resistance is futile!”
We need to take a moment to reflect and compose a comprehensive response to Mr. Cook and ePerks.com. Are we ready?
You idiots!
Cook goes on to say, “[Y]our only goal is to cast ePERKS in a negative light for personal gain.” No, Ron, that’s what you’re doing — and a damn fine job, too!
There’s more, but who cares? BloodhoundBlog gets these letters from time to time, and they’re all the same. Some dipshit corporation — in preference to delivering on its promises, honestly addressing grievances, and maintaining its reputation in the free marketplace of ideas — hires a jackass attorney to write a threatening letter that is in fact void of all threats.
Attention ePerks.com: Vlad Zablotskyy is free to criticize you — as am I — and you cannot do a damned thing about it. We are blessed in this country by a Constitution and a legal tradition that empowers the individual against the threats of the powerful. This is a wonderful thing, and it protects you as much as it does us. Hiring a legalizing thug like Mr. Cook to do violence to the idea of free speech is an act of treason to your own rights — you idiots!
In any case, I am setting my shoulder beside Vlad’s. If you want to come for him, come for me, too. I will be happy to report every detail of everything you do — to a national audience of real estate professionals numbering in the tens of thousands. I detest lead vendors, and I will be beyond delighted to help you shred what remains of your shoddy reputation — you idiots!
I’m sure you will not be human enough to send Mr. Zablotskyy a letter of apology for having issued your empty threat. It doesn’t matter. Google has a long memory, and any future clients who think to investigate ePerks.com before risking their money on your sleazy leads will stumble across this post in no time.

Search the Google for “ePerks Sponsored Reviews” and you will see how they got their rankings. The strange thing is that they have never attempted to be reviewed by a real estate blogger. And the review on my blog misfired because even though I have no traffic, most of the traffic that I do have are my former colleagues and friends in real estate.

One of my own practical lodestones, as a Realtor, is, “In what light could this be portrayed by a plaintiff’s attorney.” Even if you are acting from the best of motives, if an attorney could convincingly characterize your behavior as being corrupt, you shouldn’t do it.
I don’t believe ePerks.com is acting from anything even remotely like the best of motives, but, in the world of weblogs and search engines, every player in the marketplace has to behave in a way that can stand up to public scrutiny.
But: That’s a worthy goal for BloodhoundBlog, I think. Russell Shaw thinks we’re at this point already, but I’m yet to be convinced. But it would be beyond wonderful if every general counsel for every vendor in the real estate industry had a homily on the wall reading, “How would what we are doing hold up to scrutiny on BloodhoundBlog?” That’s a world without walls.

I think the entire issue with them is that the founders drew on their experience in automotive market and lead generating for that industry.
I still think that the model can work. But if you charge $200 a month for the service you better be ready for some scrutiny. Some agents were with them for several months without a single lead… I think you can do better than that with a PPC campaign or a solid press release.

I have never used ePerks.com so I didn’t know that ePerks.com might be a rip off. The only way I found out that ePerks.com might be a rip off was by stumbling across various blogs about the cease and desist letter from the lawyer to Vlad claiming that ePerks.com wasn’t a rip off.
The manufactured charges against Vlad leaves me to presume the ePerks.com is actually a rip off. Why else would they use such heavy handed tactics trying to prove that ePerks.com is not a rip off? I am not saying that ePerks.com is a rip off but after following the blog world I am coming to the belief that ePerks.com is actually a rip off.
Is there anybody out there who can tell us if ePerks.com is a rip off or do they provide the leads they promise?

That is what I am hoping. At least now they getting attention for real estate agents. Come on, how many agents are reading Mashable? It will take a day or two for Bloodhhoud to rank on front page for searches related to ePerks then you will see what will happened.
I think one of the reason they got so upset with me was that my blog ranked #1 on Google for “eperks scam”…. Which by the way I regained that position thanks to Greg (Swann).
Also they are accusing me for not allowing “positive” comments. Mr. Cook probably did not bother to read that original thread. There are plenty of unchallenged positive comments. I challenged only a few that were posting two or three comments during one visit while using different names. They were lucky I did not ban them from my blog.

BUT (and read this CLEARLY e-PERKS) WHEN you deliver bum goods and/or attempt to censor criticism, you are on the WRONG side of the equation. As Greg indicated Google has a long memory–
It is truly frustrating to see people attempting to silence others with a muzzle 8 years now after the Cluetrain…have you IDIOTS at E-Perks learned NOTHING?
Markets are conversations and Google is the clerk recorder who writes them down for history and who doesn’t take a coffee break.

worth the money I paid” or “it sucks”) is not outright lies or defamatory(like “Joe X Mary Y and Greg Z of C corp are all convicted embezzlers and child molestors”, if not true of course)
In the case of the former statement a follow up with the customer and perhaps even a thank you letter for candid feedback is warranted.
In the case of the latter statement a lawyer letter may be warranted.
The best thing a company can get is an honest assesment of its products and services.
From there they can work on improvement.
As such we at homegain are working on “retooling the chokepoint”.
You’ll see more tangible evidence in the coming weeks….

Free speech should be protected. What some people, however, don’t undertand is that free speech is not absolute.
The constitution does not protect ALL types of speech.
-eg. one can’t falsely shout fire in a crowded theater,
nor can one make defamatory and false statements with impunity.
However, comments from dissatisfied customers should not be squashed (unless they are accompanied by knowing and patently false and/or defamatory statements)

Lead generators are all junk. Do not waste money on leads. These lead generators simply want to become middle men, you can generate similar results by spending some time and money on building good solid lead generation real estate web site and simply competing for the clicks on google and yahoo. Housevalues, homegain.com, realestate.com and tons of others are simply wedging themselves in the way of the consumer and agent.

I had made some quick calculations. Last month there were about 17353 unique visitors, lets presume for a moment that all these visitors were quired through PPC at $1 a click. $17,535, right?
With 2700 agents at $129 per month for a Zip code they are cashing in at least $348,300.00.
Are you kidding me? No wonder they want to sue me. With 300 closings (according to Inman News) only every 9th agent had any success with these guys.
Tell me who is the winner here.

I had a sleepless night (one of many) so please forgive me if I do not make much sense.
Last night I asked on my blog that agents and brokers would forward to me the solicitation e-mails they have received from ePerks. The person who posted about me on Yahoo! Answers and had threatened me on my blog when I told his I would ban him if he did not stop accusing me of fabricating comments, was visiting form the following range of IP Addresses (76.206.0.160 – 76.206.0.167).
Some of the e-mails ePerks have sent out, like the one posted by The Harriman Team, did originate on 76.206.0.160 . Mr. Berhouzi denied again and again that his company has anything to do with that range of IP Addresses.
I have forwarded the copies to my attorney and am waiting for a call from him. And then I maybe able to take a nap.
Again, thank you for taking a stand for an “insignificant” blogger.

New to blog – here’s my long story short: I paid my (nearly $500 a month) service fees for a full eight months (embarrassed blush), did not rcv any qualified leads, reported my dissatisfaction to co. regularly, finally went thru the lengthy ePERKS process to request the guaranteed refund, was approved for a refund, and wha la – (rolling my eyes) I rcv’d a handsome Refund Certificate stating my refund had been approved (oh joy) and I would rcv my credit 12/15/2008 (an 8 month waiting period!!!) and oh by the way the certificate states it can not be copied or disclosed to any 3rd party or individual (nice). I will file formal complaints w, BBB, DRE, Local, State and National REALTOR Associations etc. Fingers crossed, but not holding my breath, I rcv a refund! Anyone else w/ this experience ?????

My little exposure to Vlad, has shown him to an individual willing to help real estate agents where he can and this situation with Mr. Behrouzi is rather unfair.
Greg as you pointed we have just honored our veterans that have fought for our freedoms, one of which is the freedom of speech.
I further think it is crazy for someone to ask another person to remove posts on someone else’s blog. If it is that important for the posts to be removed – let Mr. Behrouzi contact the bloggers himself. Or at a minimum post a rebuttal to the post or maybe even just let it go.
Mr. Behrouzi has probably put more his business on more people’s radar than Vlad could have achieved.

Hmmm… I totally missed this party until reading Andy Beard’s post today. So, they sued a blogger after asking for editorial advertising becasue they didn’t like the comments or follow up. Hmm… just goes to show you what you get when you do not have a stringent enough agreement in place for such content recruitment. I worked with plenty of companies that use editorial content for engagement and this never happened (even with other companies that had reputation problems). Sounds to me like they had a very bad legal department or none at all.

No, I have not been served the summons, so I am beginning to suspect it was just a threat.
There was also coverage by borkerscience.com and andybeard.eu in connection to my situation. I am not holding my breath but I would guess that after Greg pushed the issue here and bot Trace Richardson and Andy Beard had written in connection to my story, they may reconsider to pursue the lawsuit after me.
However, I am not taking things for grated and am preparing to a face off. I can be certain of what they will or will not do.

Never heard of e-perks but I am not found of any lead generation company. Realtors need to put these people out of business by hanging up and leaving their credit cards in their pocket. Get your own leads folks and stop paying for something that you can get on your own.
The You-Tube video was disgusting. Certainly speaks volumes for them.
Can’t imagine anyone taking on this case. Free speech I believe, is still one of our American rights.

sock-puppets, hobby-horses, name calling–I see a pattern here. Satire generally has a degree of irony to it. The eJerks logo is satirical and funny. “Sleazebag” is juvenile, not satirical. But I’d have to say that trying to position blogs in the first position for google search term “eperks” in order to ruin the reputation of a company is an attempt to inflict injury. I wasn’t clear. I’m not suggesting a class-action suit based on Vlad’s experience. I’m suggesting a class action suit against ePerks for misrepresenting their product to agents. From my review of blogs like this, there are dozens of agents who have been mislead–that’s a pretext? I am currently an aggrieved party as I currently have an acct at ePerks. I’m not looking for a pretext to inflict injury, I’m looking to right a wrong against probably hundreds of agents. As a real estate blog, I’d think this the perfect place to discuss this issue. If this is now simply a forum to discuss the nuances of free speech, let us know that.
Libel, slander, defamation shouldn’t be tolorated and has despicable as it is, eperks demand is not censorhship. Vlad should be able to take all legal means necessary to take whoever posted the pedophilia post to court for defamation and I don’t think anyone would say that he was stifling free speech. So too, however wrong they are, and they are wrong, eperks has the right to seek remedy against libel if that’s what they feel Vlad’s blog is. This is not censorship, its a civil matter. Censorship is a goverment action.
Saying all that, I think that whoever posted the pedophelia slur against Vlad is a despicable human being and I would hope that Vlad not just defend himself, but also sue for libel. I don’t think anyone would feel that doing so wasn’t just. Agents going after eperks is also just.

Not only do I have the stamdard ePERKS written guarantee, before subscribing to the service I secured a written commitment from Ben Bitter and the Ops Manager/VP Kevin Morris stating I’d receive my refund with-in ONE month – no one said anything about a ‘refund certificate’ and having to wait 8 months for the refund (if they haven’t filed Bankruptcy by then!). I’ve spent most of the day preparing to file complaints with the BBB, California Realtors Association & Department of Real Estate. Holy Mackerel!!!

I was told that if I signed up 2 exclusive zip codes and did not close a sale in 6 months they would issue a full refund. Instead, the rep is gone and I am told that it was a promo they had last Christmas. If that is the case, then how did I know about their promo? They lie, cheat and steal, and bully people to try to collect when a dispute is filed. I filed with my credit card company and they are sending me to collections? Beware of the ejerks! They are full of garbage, they need to be taken out of business. I will not be bullied. I filed reports to the AG office in CA, their local BBB, and the FTC. I also filed with the AG in my state of WA and will keep filing complaints. They will not get away with their fraudulent activities and need to be stopped.

This company eperks is a ripoff. They told me if I did not take the two zipcodes in my area that another realtor in my office would. I was on my way out the door and gave her my credit card number and told her if I did not want to do this that I was going to cancel the next day. I proceeded to call the woman they said was going to take the zipcodes if I was not and she said that she was never going to go with this company. I called my American Express people and told them I wanted the charge taken off my bill and they did an investigation and removed the $379 from my bill. EPerks has since sent me to a collection agency and are going to use this against my credit rating. They suck and they even put a bio of me that they took from my real estate website without my permission.

I just got the collections letter too, are you paying it? I have not yet as they are liars and mislead all of us. Please see the BBB in CA to find that eperks has 38 compliants, and I filed a complaint with them as well as the AG in CA, the real estate commission of CA, and the FTC. The more complaints they recieve the better. I even file with my state AG.
If anyone out there has gotten their collections letter please share with us what happened next and how and if it was resolved.

Yes, got the collections letter –
After paying in excess of $6000. over 8 months, when I registered a complaint w/ my credit card they credited only 1 month of eJERKS fees and Wha La – the collections notice followed. When I called ePerks I was told the 1 months creidit would stop my refund which (while I cancelled in March and was given a guarantee I’d have my refund w/in 30 days) is scheduled for Dec 16 2008. I am not sure what to expect. My fear is they have been using the time (while not paying the guaranteed refunds) to make a case for Bankruptcy.
I welcome any help in getting my refund.
PS – They never took any further action (collections) that I am aware of and it has not effected my credit.

I am so sorry that happened. I was told by the CA AG office if they get enough complaints they go after eperks and get your money back. Make sure to file all of the complaints you can. Did they have a payment plan? This is ridiculous! I was also told that if you dispute your credit bureau they also look into it, if enough people do it. There is power in numbers nd the more people who step up the better for ll of us. They always talk about refunds, but I have not seen or heard of anyone actually getting it from eperks. I will keep you informed.

Ben ruined not only his name but also Brabus Ventures Corp and eperks, so now he is starting over. His new business is run under the name dotnextinc.com, but don’t think he has changed his business ethics any (or lack of) because he still uses the same techniques from what I can see. He still has shills commenting for him and praising his new venture, just exactly the way he started eperks. He even goes so far as to say he didn’t know they were doing it after they were caught red handed, LMAO.

Big Surprise! December 15th 2008 has come and gone and that refund certificate ePerks issued promising a full refund (12/15/08) after terminating service and a nine month wait (this after 8 months of on time paid service fees) still is just that – a certificate.
No refund in sight.
After filing claims with the credit card company, the BBB, the Attorney General and the Department of Real Estate I am still out close to $4000.00. I am not done but I am discouraged.
Next? Small Claims Court.
Has anyone received their refund?

I am not surprised! I contacted the local media and encourage all of you to do the same. He will not pay you back and they will continue to rip others off and threaten the little guy. I would file a suit against them. I have searched an found nobody yet who has recieved a refund. Can you tell me what they promised you? I was told I would get a full refund and they changed their story. They had us all sign uo thinking they would be advertising on the web, Harmon Homes, and TV stations. I keep searching and I find no ads. I found a website that searches for hits and they ceased advertising last January 2008. So they conned us into buying a service which they are not providing.
